In 2004 the Department of Energy (DOE) established their Human Reliability Program (HRP). This program is designed to protect national security via a system of continuous evaluation of individuals working in positions affording unescorted access to certain materials, facilities and programs. Among other things, the HRP requires alcohol and drug testing. The HRP is monitored and administered by DOE’s Office of Health, Safety and Security.
Alcohol testing under the Human Reliability Program must follow the DOT procedures in 49 CFR Part 40 Subparts J-N. Drug testing must be done according to 10 CFR Part 707 which follows the Department of Health and Human Services procedures for federal drug tests.
On July 30, 2010 the U.S. DOE published a Request for Information relative to their 10 CFR Part 707 rule, Workplace Substance Abuse Programs for DOE Contractors. Among other things, the Department is asking for opinions about adding alcohol testing requirements to Part 707. Any comments are required to be submitted by October 28, 2010.
